All services provided by Cogentinternet.com may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene or material protected by trade secret and other statute, and invasion of privacy. The subscriber agrees to indemnify and hold harmless Cogentinternet.com from any claims resulting from the use of the service which damages the subscriber or any other party.

Also prohibited are sites that promote any illegal activity or present content that may be damaging to Cogentinternet.com servers or any other server on the Internet. Links to such materials are also prohibited.

will be the sole arbiter as to what constitutes a

violation of this provision. We are not responsible for client account content, but make every effort at removing questionable material.<br><br>

Clients are responsible for maintaining backups of their content.
Cogent Internet will provide a current downloadable backup via the cPanel
to assist the client in keeping their backups up-to-date.<br><br>

In the event that any particular clients' material is not "Server-ready", Cogentinternet.com may, at its option and at any time, reject this material, including, but not limited to after it has been put on Cogentinternet.com's webservers. This includes Cogentinternet.com's right to disable such non-"Server-ready" materials, such as CGI scripts or programs which consume an unreasonable amount of CPU (Central Processing Unit) usage or RAM (Random Access Memory) as determined by Cogentinternet.com. Cogentinternet.com may also at its discretion at any time, suspend access to any client's website without notice, due to over-consumption of bandwidth (exceeding plan's quota), CPU usage, or any other reason which might effect the performance of Cogentinternet.com services. Cogentinternet.com agrees to notify Client immediately of its refusal of the material and/or suspension of the account and afford Client the opportunity to amend or modify the material to satisfy the needs and/or requirements of Cogentinternet.com. If the Client fails to modify the material, as directed by Cogentinternet.com, within a reasonable period of time established by Cogentinternet.com, the Agreement shall be deemed to be terminated.

<p><font face="Arial" size="2"><b>File Distribution/Mirroring</b></font></p>

<p><font face="Arial" size="2">Cogentinternet.com forbids use of service for those who provide mirroring service for other website or websites, and/or whose primary purpose is file distribution. Distribution of executable programs, archive files, or other non-visual file types are not welcome. Client's whose accounts who are found in violation of this policy may, at the discretion of Cogentinternet.com, have their account(s) terminated without notice.

Advertising - Email:

Spamming, or the sending of unsolicited email, from a Cogentinternet.com server or using an email address or domain that is maintained on a Cogentinternet.com machine as reference is STRICTLY prohibited.

Cogentinternet.com will be the sole arbiter as to what constitutes a violation of this provision.

Misuse of System Resources:

Any attempt to undermine or cause harm to a server, or customer, of Cogentinternet.com is strictly prohibited. This includes, but is not limited to: using programs that consume excessive CPU time; allowing the use of mail services, mail forwarding capabilities, or autoresponders other than for the customer's own account; resale of disk space without an appropriate reseller agreement; use of servers for backup of files unrelated to the web site of the account; or resale or remote access to CGI scripts installed on our servers.

Operation of IRC servers or IRC bots on our servers will result in an immediate suspension of service.
